Overview
These are the terms that apply when you use the Perchcats website or buy from our store. "We," "us," and "our" mean Perchcats. The store runs on Shopify.
By using this site, you agree to these Terms and our Privacy Policy. If you don't agree, don't use the site.
Section 1: Access and Account
You need to be the age of majority in your state, province, or territory to use this site. If you're allowing a minor in your household to use it on your device, that's on you.
When you create an account or place an order, the information you give us needs to be accurate and current. You're responsible for keeping your account credentials safe. Don't share, sell, or transfer your account to anyone else.
Section 2: Our Products
We do our best to show products accurately: photos, colors, dimensions, and descriptions. That said, colors can look different depending on your screen and device settings, so what you see may not be a perfect match to what arrives.
Product descriptions can change at any time without notice. We can also pull a product, limit quantities, or restrict sales to certain regions whenever we need to.
Section 3: Orders
Placing an order is an offer to buy, not a confirmed purchase. Perchcats can accept or decline any order for any reason. Your order isn't confirmed until we process your payment and send confirmation.
Check your order before you submit it. Once it's in, we can't cancel or modify it. If we need to make a change or cancel on our end, we'll contact you using the details you gave at checkout.
All purchases are for personal or household use only not for resale or commercial export.
Section 4: Prices and Billing
Prices can change without notice. What you pay is the price shown when you place the order; that's what your confirmation email will reflect.
Prices don't include taxes, shipping, customs, or import charges unless stated otherwise. If we run a promotion that conflicts with these Terms, the promotion terms take over for that transaction.
When you buy from us, you're confirming that your payment details are accurate, you're authorized to use that payment method, and your provider will honor the charge. Keep your billing and account info up to date so we can process orders without issues.
Section 5: Shipping and Delivery
Orders go out within 10-14 business days. Delivery times are estimates, not guarantees. Bulky items like cat trees can take longer depending on where you are and which carrier picks it up. Delays caused by carriers, customs, or things outside our control aren't something we can be held responsible for.
Free standard shipping on orders over $100. Under that, the rate gets calculated at checkout.
Once your order is with the carrier, risk of loss transfers to you. If something looks wrong with your delivery, email us at hello@perchcats.com.
Section 6: Intellectual Property
Everything on the Perchcats site, text, images, graphics, logos, product names, designs, video, and audio, belongs to Perchcats or our licensors and is protected under intellectual property law.
You can use the site for personal, non-commercial browsing only. You can't copy, reproduce, modify, distribute, or republish any part of it without written permission from us. Trademarks belong to their respective owners. Unauthorized use may break the law.
Section 7: Optional Tools
We may give you access to third-party tools through the site, things we don't control, monitor, or endorse. Any use of those tools is entirely at your own risk. Check the relevant third party's own terms before using them. We may add new tools or features down the track, and those will fall under these Terms too.
Section 8: Third-Party Links
This site may include links to external websites we don't own or operate. We're not responsible for their content, accuracy, or practices. If you leave our site to visit one, you do so at your own risk. Any complaints about third-party products or services go to that third party directly.
Section 9: Relationship with Shopify
Perchcats runs on Shopify. That said, every transaction you make is with Perchcats, not Shopify. Shopify isn't responsible for anything related to your purchases here. By using this site, you release Shopify from any claims arising from your transactions with us.
Section 10: Privacy Policy
Any personal information collected through this site is handled in line with our Privacy Policy. Because the store runs on Shopify, Shopify also collects and processes certain data about your use of the site. Check our Privacy Policy for the full picture on how that data is used.
Section 11: Feedback
If you send us reviews, suggestions, ideas, or any other feedback, you're giving Perchcats a permanent, royalty-free license to use it for any purpose, including commercial use. We can use, modify, publish, or distribute it without paying you or keeping it confidential.
When you submit feedback, you're confirming you own it, it's accurate, and it doesn't violate anyone else's rights. Don't submit anything defamatory, obscene, or illegal. You're responsible for what you send.
Section 12: Errors, Inaccuracies and Omissions
Sometimes there are typos or outdated information on the site's pricing, promotions, product descriptions, and shipping details. We can correct those at any time without notice, including after you've placed an order.
Section 13: Prohibited Uses
You can use this site for lawful purposes only. You can't use it to:
Break any law or regulation
Harass, abuse, or harm anyone
Send spam or unsolicited promotions
Upload viruses or malicious code
Scrape, copy, or extract any part of the site using automated tools
Impersonate someone else
Interfere with the site's security or access controls
We can suspend or terminate your access at any time if you breach these Terms.
Section 14: Agents
If you're using any software or automated service ("Agent") to access or interact with this site, that Agent must identify itself in every HTTP/HTTPS request, including the Agent name in the user agent string. It can't mimic human behavior, bypass CAPTCHAs, or hide that it's not a person. We can block or limit Agent access at any time. If we've told an Agent to stop accessing the site, it must stop.
Section 15: Termination
We can end your access to this site at any time, without notice, for any reason. Any amounts you owe up to the date of termination remain payable. Sections covering intellectual property, feedback, warranties, liability, indemnification, and governing law continue to apply after termination.
Section 16: Disclaimer of Warranties
Information on this site is for general reference. We don't guarantee it's accurate or complete. You rely on it at your own risk.
Except where required by law, Perchcats products and services are provided "as is" and "as available" with no warranties, express or implied. That includes merchantability, fitness for purpose, durability, or uninterrupted service.
Where consumer protection laws in your jurisdiction imply guarantees that can't be excluded, our liability is limited to replacing or repairing the goods, supplying equivalent goods, or refunding the purchase price.
Section 17: Limitation of Liability
To the fullest extent permitted by law, Perchcats, our directors, employees, affiliates, contractors, and service providers are not liable for any indirect, incidental, punitive, or consequential damages, including lost profits, lost data, or replacement costs, arising from your use of this site or our products.
This doesn't apply where the law in your jurisdiction prevents us from limiting liability under consumer protection provisions.
Section 18: Indemnification
You agree to indemnify and hold harmless Perchcats, Shopify, and our affiliates from any claims, losses, or legal costs arising from your breach of these Terms, your violation of any law, or your use of this site.
If an indemnifiable claim comes up, we may take control of the defense at your expense, but we won't settle anything that puts obligations on you without your consent (which you can't unreasonably withhold). You'll cooperate with us and provide relevant documents as needed.
Section 19: Severability
If any part of these Terms is found to be unenforceable or invalid, that part gets removed or limited to the minimum necessary. The rest of the Terms stay in full effect.
Section 20: Waiver: Entire Agreement
If we don't enforce a right under these Terms at any point, that doesn't mean we've waived it. These Terms, along with any policies referenced here, are the full agreement between you and Perchcats. They replace any prior agreements, verbal or written.
Section 21: Assignment
You can't transfer or assign your rights under these Terms to anyone else without our written approval, and any attempt to do so is void. We can transfer our rights and obligations without needing to notify you.
Section 22: Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes go to the courts of Queensland. If you're outside Australia, you're also responsible for compliance with your own local laws.
Section 23: Changes to Terms of Service
We can update these Terms at any time by posting changes on this page. For material changes, we'll notify you as required by law. Continuing to use the site after changes are posted means you accept them. Check this page periodically.
